We are a boutique hosting business with over 2 years experience. Our goal is to make our guests feel like they're right at home in any of our properties. You can book in confidence knowing you're in the hands of a Superhost! Here's what you can expect at The Niuk: KITCHEN -fully stocked kitchen to prepare your meals (pots/pans, dishes, utensils, drinkware, etc.) -coffee station with standard 12 cup pot and k-cup capabilities and a starter supply of coffee, tea, sweeteners and creamer -extra amenities such as an instapot, rice maker, blender, toaster, etc. DINING -seating for 6 at the dining table LIVING ROOM -couch and 2 swivel chairs -gas fireplace -TV with roku device so guests can log into their favorite subscriptions PRIMARY BEDROOM + BATHROOM -king bed with memory foam mattress, nightstand, reading chair, closet with luggage rack -smart TV so guests can log into their own subscriptions -en suite bathroom with shower, soaking tub, double sink vanity, toilet closet -shampoo, conditioner, body wash -bath towels provided BEDROOM #2 -queen bed with memory foam mattress, nightstands, dresser, luggage rack -full length mirror -TV with roku device so guests can log into their own subscriptions GUEST BATHROOM -shower/tub combo, sink, vanity, toilet -shampoo, conditioner, body wash -bath towels provided BEDROOM #3 -twin over full bunk bed, nightstand, dresser -TV with roku device so guests can log into their own subscriptions LAUNDRY CLOSET -stackable washer/dryer -starter supply of laundry detergent -iron and ironing board PATIO -seating for 2 at our bar height Adirondack chairs with adjoining table -great views of Park St, Water St, Mama Tig's, volleyball court, festival lawn, etc. LINENS AND TOWELS ARE PROVIDED PARKING -Parking is available in the lot adjacent to our condo building. Guests must register their vehicle(s) per city ordinance. Vehicle registration is free. More information will be provided before arrival. You must be 24 years or older to rent this property. Guest must read and sign (electronically) our Rental Agreement before check-in instructions will be sent. Please see Rental Agreement below. Guest access Check in is anytime after 4:00 PM - This is the earliest we can promise to have the property available for your stay. We can occasionally accommodate early check-ins however, these are not guaranteed and must be pre-arranged with your host. If you need a guaranteed early check-in time, it is recommended to add the additional night before (if available) to your reservation. Please contact the host for a possible discounted rate. Guests will have private access to the property via keyless entry. PLEASE NOTE: Rental agreement must be electronically signed before check-in instructions will be sent. Once signed, check-in instructions including property access details, door code, etc. will be sent via email and/or booking platform messaging the day before your scheduled arrival. We are not responsible for the community pools/hot tub. If at any point these are not available for use, no refunds or rate adjustments will be given. *Guests will want to bring (if desired) their own volleyball, basketball, racket ball equipment if you chose to participate in these amenities which are available in the community. Maximum number of guests allowed: 7 Please note the sleeping arrangements include a bunk bed. Due to safety restrictions for bunk beds and to promote the best experience for our guests, the maximum number of adults allowed is 6. SHORT TERM RENTAL AGREEMENT Thank you so much for choosing The Simple Life Cabin Rentals, LLC. We greatly appreciate your reservation and look forward to welcoming you as a guest. This Rental Agreement (hereinafter called “Contract”) creates a binding agreement between the individual, family, group or legal entity renting (hereinafter called “Guest”, “you” or “your”) vacation rental homes (hereinafter called “Vacation Home”, “property” or “premises”) and The Simple Life Cabin Rentals LLC (hereinafter called “TSLCR”, “Management”, “Host”, “we” or “us”), who is the contracted agent on behalf of the owner of the property. Please review this Contract in its entirety. TERM OF OCCUPANCY: The term of occupancy shall be strictly for the number of nights outlined in the reservation and will begin at 4 PM on the date of arrival. Guest must vacate the Vacation Home no later than 11 AM on the date of departure. RENT: Payment is due in full (including rent, fees and taxes) at the time of booking in order to secure a reservation. If Guest is booking this reservation through Airbnb, any and all payments will be handled by Airbnb and no credit card information will need to be submitted to TSLCR. Once a reservation is accepted and paid in full, you will receive a confirmation notice. Check-in instructions, including your unique access code and the property address will be sent within 48 hours of your scheduled arrival time. Guest understands this Contract must be signed and returned before check-in information will be sent. If Guest refuses to sign this Contract, reservation will be canceled and refund will be given according to the Cancellation and Refund Policy. GUEST QUALIFICATION: Rental reservations must be held in the name of, and check-in completed by, an individual who is at least twenty-four (24) years of age and acknowledges TSLCR may require a copy of Guest drivers license as proof of identity. Guest is responsible for all other persons staying or visiting the property during the reservation. LIMITED OCCUPANCY: Maximum occupancy is limited to the number of individuals shown on the property listing and is in effect 24 hours a day. NO SUBLETTING: Guest may not sublet or assign this Contract for all or any part of the premises under any circumstances. NON-DISTURBANCE CLAUSE: Guest shall not disturb/endanger neighbors or use the premises for any unlawful purposes. Quiet hours shall be observed between 11pm - 7am. Guest understands that TSLCR cannot guarantee that neighboring properties or any complex a property resides in will be free from disturbances, construction, repairs or maintenance. These disturbances are not a reason for termination of this Contract, nor is it a reason for a refund. NO SMOKING/VAPING: Smoking, vaping, candle and/or incense burning is strictly prohibited. No firearms, explosives, fireworks or other dangerous items shall be brought to or permitted upon the premises. Further, Guest shall not engage in the use of any illicit or illegal drugs or substances at the property nor shall Guest permit others in the rental party to participate in such activity. Any violation of the above mentioned constitutes grounds for automatic eviction plus forfeiture of the total reservation cost. DAMAGE TO PROPERTY: Guest is responsible for the Vacation Home, its contents and its guests during the term of occupancy. Guest must lock windows and doors securely when not on the premises. Removing items from the property and/or rearranging furniture is prohibited. After check-out, Management will inspect the property for damage, missing items and the overall condition the Vacation Home was left in upon check-out. If we determine that damage is present, items are missing or the Vacation Home was left abnormally dirty upon check-out, Guest agrees to fully reimburse TSLCR for the repair or replacement cost of any damages, missing items and/or additional cleaning required upon Guest check-out. REPAIRS AND MAINTENANCE: All property is provided in an “as is” condition. Guest will report any maintenance/safety issues immediately. TSLCR makes every effort to ensure all equipment in the vacation rental property is in good working order. In the event of an unforeseen mechanical failure, equipment failure or utility outage, we will do our best to have the issue resolved in a reasonable amount of time. Please note any unresolved issues of this nature do not obligate TSLCR to provide any rate adjustments or refunds to Guest. INTERNET ACCESS: WiFi access is provided as a courtesy for Guests. However, this service can sometimes be erratic. TSLCR makes every effort to ensure service is working properly, but is not responsible for problems with internet service or your device(s) (i.e. laptop, cellphone, tablet, etc.) being used to access the internet. No refunds are issued for internet service problems. Use of the provided internet for any type of illegal activity is strictly prohibited. HOT TUB/POOL USE: Some TSLCR properties have private hot tubs and/or pools. These amenities are routinely maintained and serviced. This maintenance may occur during your stay. Guest must allow access to the property to perform these services (Management will enter the property to perform this service if Guest is not on the premises). Some properties include access to shared community hot tubs and/or pools. These amenities are serviced by a third party provider not related in any way to us. Since we are not responsible for the care and maintenance of these hot tubs and/or pools, TSLCR makes no guarantee on the usage and/or availability of these amenities. In the event these shared community amenities are not suitable and/or available for use, no refunds will be given. Guests shall observe and adhere to all rules and policies as posted at the property and/or in any and all written information regarding safe use of the hot tub/pool. The hot tub/pool and surrounding patio/deck can be dangerous and slippery when wet. Guest accepts and assumes all risks involved in, or related to, the use of the hot tub/pool and patio/deck areas and releases TSLCR, Management and the Homeowner from any and all liability or loss that may result in connection with the use of the hot tub/pool and/or patio/deck. If there is a problem with the hot tub/pool Guest should contact TSLCR immediately and we will make every effort to have the unit fully functional for Guest use. Although rare, hot tubs/pools do break down. Since this amenity is provided at no additional fee, no rate adjustments or refunds will be issued in the event the hot tub/pool is unavailable for use. SAFETY: Guest must “baby-proof” the Vacation Home and premises to their individual safety standards and supervise children/minors at all times. Guest shall inspect and be familiar with proper use and application of any portion or component of the property prior to its use. Guest will use discretion and leverage hand railings where possible for walking on steps and outdoor surfaces. Guest understands you are responsible for your own security while on the premises by locking doors, windows, etc. when it is prudent to do so. PERSONAL EFFECTS: Guest is responsible for any personal items brought onto the property and are encouraged to have proper coverage via an insurance policy of their choosing. We are not responsible for items left behind but will make every attempt to return them if notified. Guest agrees to reimburse TSLCR for the postage cost plus a $10 handling fee. CANCELLATIONS/REFUNDS: Cancellations received at least 14 days before check-in will be issued a 90% refund of the total booking amount. TSLCR will retain a 10% processing fee. Cancellations received less than 14 days but more than 7 days before check-in will be issued a 50% refund of the total booking amount. Cancellations received less than 7 days before check-in will not be refunded. Refunds exclude any applicable credit card processing fees. For reservations made through an online travel agency such as Airbnb and VRBO the cancellation/refund policy will be shown in that individual reservation and will supersede this policy. TSLCR is not able to give refunds or make changes to reservations due to weather related issues, acts of God (i.e. snow, wind, rain, power outages, etc.), medical emergencies, illness, death, pandemics or any other causes beyond control. No refunds will be given for delayed arrivals, early departures or no-shows. If you have concerns about a cancellation, we strongly suggest you consider third party travel insurance options. ADDITIONAL RULES: Guest will not host events and/or parties on the premises. No professional photography/videography or vendors of any kind are allowed on the property without prior authorization by Management. INDEMNIFICATION/HOLD HARMLESS PROVISIONS: Guest hereby agrees to indemnify and hold the owner of the Vacation Home and Management, including its agents, employees, and representatives harmless from any liability for personal injury, theft, destruction or property damage sustained by Guest or parties invited onto the premises by Guest. This includes, without limitation, attorney fees and costs, arising out of or in any way related to the use of the property by Guest or any invitees of Guest. Guest assumes the risk of injury or other losses relating to the use of the property and any activities conducted thereon, and agrees that the release and hold harmless provisions of this Contract shall also apply to any activities of Guest and invitees and agents on the property. To the extent not covered by the release provisions above, TSLCR shall not be liable for special or consequential damages such as, but not limited to, loss of profits or revenue, cost of capital, cost of purchase of replacement goods or property, claims for emotional distress, mental suffering or the like. In all cases, Guest agrees to waive any potential claim for punitive damages of any kind, regardless of the underlying claim or claims. The remedies of the Guest set forth herein are the exclusive remedies available against TSLCR. Any liability of the owner of the Vacation Home and Management, including its agents, employees, and representatives with respect to this Contract or property covered by this Contract, or anything done in connection therewith, such as the performance or breach of the Contract, or maintenance, rental, or management of the property, whether statutory, or arising in negligence, contract, tort, strict liability, or under warranty, or otherwise, shall not exceed the sum of rent collected for the rental reservation under the rental contract giving rise to the claim. Guest acknowledges that this limitation of liability is directly tied to the total price charged for the rental reservation of the property associated with this Contract. SEVERABILITY: If any provision of this Contract is determined to be illegal or unenforceable, the validity of the remaining provisions hereof shall not be affected hereby; and such illegal or unenforceable provision shall be deemed modified to the minimum extent necessary to make it consistent with applicable law and, in its modified form, such provision shall then be enforceable and enforced. ARBITRATION: In the event of any dispute, claim, question, or disagreement arising from or relating to this Agreement or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, or disagreement. To this effect, they shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. If they do not reach such solution within a period of 60 days, then, upon notice by either party to the other, all disputes, claims, questions, or differences shall be finally settled by arbitration administered by the American Arbitration Association in accordance with the provisions of its Commercial Arbitration Rules. Within 14 days after the commencement of arbitration, each party shall select one person to act as arbitrator and the two selected shall select a third arbitrator within 10 days of their appointment. The party-selected arbitrators will serve in a non-neutral capacity. If the arbitrators selected by the parties are unable or fail to agree upon the third arbitrator, the third arbitrator shall be selected by the American Arbitration Association. APPLICABLE LAW: This Contract shall be governed by and construed in accordance with the law of the state of Oklahoma. If any suit or action is filed by any part to enforce this Contract or otherwise with respect to the subject matter of this Contract, exclusive venue shall be in the circuit court for the county of the particular property named in this Contract. Nothing in this provision shall be deemed to diminish in any way the obligation of the parties to arbitrate any dispute. By signing (electronically) this Contract, you acknowledge that you have read, understand and agree to comply with the terms mentioned above and assume the responsibility for the obligations set forth herein. TSLCR Vacation Homes are available for reservations to all peoples with no discrimination based on race, color, religion, gender, national origin, age, veteran status or disability.
