This private 14-acre property is a "one of a kind " located just 2 hrs from NYC, close to hiking areas & Woodstock - 25 mins away. This newly renovated property has a gorgeous living room with wood stove & views of the falls. A massive lawn w/ volleyball net, outdoor dining & firepit make this the perfect escape. Take it easy at this extremely unique & tranquil getaway. The space The house has two bedrooms and a bathroom (one king bed & one bunk bed) On request, there is also a Bonus space in the basement. It consists of an extra bedroom with queen bed & full bathroom. There's no internal staircase to access the main house, you need to go through the main entrance. Please note, this is NOT the same level of decor as the upstairs furnishings - it is very basic. It is ideal if you have a teenager who wants their own space or some friends visiting for a couple of days. Guest access You'll need a car to access the property. There is amble parking & a car port (particularly useful during the winter months). Other things to note We will need guests to sign a waiver prior to arrival (SEE BELOW). The falls & the swim holes can be accessed, but at guests own risk. Pets allowed - a $65 pet fee applies. Max of one pet. Like most places in the area, there is limited cell service. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any policies, oral/written instructions or directions provided by Dylan Falls Enterprises, Inc. or its employees, representatives or agents of thereof. 2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Dylan Falls Enterprises, Inc. for injury, loss or damage arising out of my or my family’s use of or presence upon the facilities of [421 Brown Road, Olivebridge, NY 12461, whether caused by the fault of myself or my family, Dylan Falls Enterprises, Inc., or other third parties. 3. NO WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DYLAN FALLS ENTERPRISES, INC. DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING (i) THE IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGMENT AND FITNESS FOR A PARTICULAR PURPOSE, AND (ii) WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING OR PERFORMANCE OR USAGE OF TRADE. DYLAN FALLS ENTERPRISES, INC. DOES NOT ASSUME ANY OTHER LIABILITY IN CONNECTION WITH ANY PRODUCTS OR SERVICES THAT IT MAY PROVIDE. 4. INDEMNIFICATION. FEES. I agree to pay for any and all damages to the facilities of 421 Brown Road, Olivebridge, NY 12461 caused by any negligent, reckless, or willful actions by me or my family. 6. APPLICABLE LAW. This Agreement shall be construed in accordance with and governed by the internal laws of the State of New York, U.S.A., without giving effect to any choice of law rule that would cause the application of the laws of any jurisdiction other than the internal laws of the State of New York to the rights and duties of the parties. 7. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Dylan Falls Enterprises, Inc. has offered to refundd any fees that I have paid to use its facilities if I choose not to sign this Agreement. 8. ARMS LENGTH AGREEMENT. This Agreement has been negotiated by the parties and shall be interpreted fairly in accordance with its terms and without any construction in favor of or against either party. 9. DISPUTE RESOLUTION. Except for matters of injunctive relief, for which either party may seek arbitration or initiate proceedings in any court of competent jurisdiction, any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be finally and exclusively determined by binding arbitration. The number of arbitrators shall be one. The place of the arbitration shall be Ulster County, New York. The arbitration shall be administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. 10. NO WAIVER. The waiver by either party of a breach of or a default under any provision of this Agreement shall not be effective unless in writing and shall not be construed as a waiver of any subsequent breach of or default under the same or any other provision of this Agreement, nor shall any delay or omission on the part of either party to exercise any right or remedy that it has or may have hereunder operate as a waiver of any right or remedy. 11. SEVERABILITY. If the application of any provision of this Agreement to any particular facts or circumstances shall for any reason be held to be invalid, illegal or unenforceable by a court, arbitration panel or other tribunal of competent jurisdiction, then (i) the validity, legality and enforceability of such provision as applied to any other particular facts or circumstances, and the other provisions of this Agreement, shall not in any way be affected or impaired thereby and (ii) such provision shall be enforced to the maximum extent possible so as to effect the intent of the parties.
